What is the Work Health and Safety Bill 2011 in New South Wales?

The New South Wales Government has submitted the Work Health and Safety Bill 2011 to parliament today.  This together with the Occupational Health and Safety Amendment Bill will be the cornerstone for the harmonised work, health and safety laws commencing in 2012.

In the media release today  the Hon Greg Pearce MLC stated that "One set of rules across Australia means one set of rules for business.  One set of rules focusing on health and safety the priority at any workplace anywhere in Australia".

This move has the backing of all governments and Chief Ministers across Australia and the harmonisation of work, health and safety laws will reduce compliance costs and red tape for employers.

The laws will:

  • incorporate a strong work, health and safety framework
  • keep businesses and business owners accountable
  • and be applied through Australia
New South Wales will see the most changes, as the process for managing safety will have changed for both businesses and particularly for unions.

The Work Health and Safety Bill and Occupational Health and Safety Amendment Bill will remove the capacity of unions to prosecute for breaches of Occupational Health and Safety laws, as well as removing the reverse onus of proof currently in place.
